Telecom operators condemn proposed communications service tax

Telecommunications operators have condemned the proposed nine per cent communications service tax the 9th National Assembly plans to re-introduce. The operators under the aegis of the Association of Telecommunications Companies of Nigeria said the 8th National Assembly which earlier considered introducing the tax in 2016 had shelved the idea after the intervention of the association.    Also, network operators belonging to the Association Licensed Telecommunications Operators of Nigeria said the proposed nine per cent tax would make life difficult for an average Nigerian as communication is presently the most affordable basic need of everyone. The President of ATCON, Olusola Teniola, noted in a statement on Thursday that ATCON executives met the former Senate President, Bukola Saraki, on November 8, 2016 where the senators acknowledged that the growth of ICT was critical to the creation of jobs and reduction in youth unemployment. Consumption tax: Respect court judgment, Lagos tells hotels, restaurants

The Lagos State Government has urged all hotels, restaurants, and events centres operators in the state to respect the decision of the court on the Lagos State Hotel Occupancy and Restaurant (Fiscalisation) Regulations 2017. The state said this in a statement on Friday that a suit challenging the consumption tax law was dismissed by the Federal High Court in Lagos on Thursday.     The Director, Public Affairs, Lagos State Ministry of Justice, Mr Kayode Oyekanmi, who signed the statement, explained that the court dismissed the claim of the plaintiffs that “since the Value Added Tax by Federal Inland Revenue contains provisions relating to the consumption, it had ‘covered the field’ and as such, no state law can impose any similar tax.”  “The judgment stated that Lagos State is the only constitutional and lawful body permitted to assess, impose and collect tax from customers for goods and services consumed in hotels, restaurants and event centres in the state. “The court granted an order of perpetual injunction to restrain the Federal Inland Revenue Service from collecting tax from customers for goods and services consumed in hotels, restaurants and event centres in Lagos State,” Oyekanmi said. The suit, which Oyekanmi spoke of, was filed last year by the Registered Trustees of Hotel Owners and Managers Association of Lagos. The association had in the suit urged the court to strike down paragraphs 4, 5, 6, 7, 8, and 11 of the Lagos consumption tax law. They urged the court to stop the Lagos State Government from installing certain gadgets in hotels and other hospitality centres for the purpose of monitoring their incomes, hence the taxes due to the state. But, according to Lagos State, Justice Rilwan Aikawa dismissed the plaintiff’s suit. “All hotels, restaurants, and events centres managers and operators are hereby enjoined to henceforth comply with the provisions of the Hotel Occupancy and Restaurant Consumption Tax Law and regulations of Lagos State as declared in the judgment of the Federal High Court,” Oyekanmi said.   Source: Punch

The Oyo State Government has reiterated its assurance to the people of the state that the administration would not increase tax on business enterprises in order to increase the Internally Generated Revenue (IGR) of the state. The Executive Chairman, Oyo State Internal Revenue Service (OYSIRS), Aremo John Adeleke, stated this in a chat with journalists in his office, saying that Governor Seyi Makinde was applying sympathy and empathy in his dealings on the matter since the new administration came into office.    According to Aremo Adeleke, the government is working assiduously to capture other areas that have not been explored to generate more revenue to the coffers of the state, adding that a culture of efficient and leak-proof collection in all areas of revenue would be put in place. “Instead of tax increment, we are emphasizing on efficient collection of existing revenue and we are bringing our informal sector into the tax net. Besides, we are reaching out to other geopolitical zones in our tax campaign. “The good performance of Governor Seyi Makinde has also changed the attitude of the stakeholders towards tax payment. Most of them are responding without any reminder. However, the economy is a big challenge for many companies as this has implication on Pay As You Earn (PAYE) remittances,” he said. Adeleke explained further that those that were reluctant to respond were being served reminders after which thorough enforcement would follow, assuring that any steps to be taken to enforce the tax drive would be legal, with human face. The chairman added that though churches and mosques were exempted from paying taxes but those with revenue earning ventures and other businesses would pay taxes, levies and any fees applicable. He used the opportunity to also call on those that were in better positions in the society to rise and assist the government to improve the standard of living of the citizenry by ensuring regular payment of their tax and dues.   Source: Daily trust

Tax increment could breed crisis – Miyatti Allah

The Zona Chairman, Miyetti Allah Cattle Breeders Association of Nigeria (MACBAN) MACBAN, Alhaji Giddado Sadiq, has explained that the group had no issue with farmers in the country especially South-east geopolitocal zone. Sadiq, who was reacting to federal government plans to increase Value Added Tax from 5 to 7.5% and CBN tax on Savings and Withdrawals for cashless policy, said that relationship between farmers and herders in the zone were cordial except that jobless (idle) people sometimes instigate crisis among them.    He appealed to president Muhammed Buhari-led federal government to reconsider decision on tax increment to avoid multiplying the sufferings of people and in turn increase unemployment which according to him breeds vices. “It might be counter productive if government increase or impose more tax on the poor masses because it will make people to suffer. You know we are still facing weak economy. There are high rate of unemployment in Nigeria. If the tax should affect those struggling to earn a living they may start engaging on social vices.  “You know it is not farmers that have issues with the herders but idle people. Vice President Yemi Osinbajo is currently meeting behind closed doors with the former Senate Leader, Senator Ali Ndume. The meeting started a few minutes past 1 pm at the vice president’s office. The meeting may not be unconnected with the Senate’s decision to introduce an action to impose tax on communication services in the country. The bill for an act to establish the Communication Service Tax was formally introduced on the floor of the Senate on Wednesday is being sponsored by Ndume.    The lawmaker from Borno State, had told newsmen after the first reading of the bill that the imposition of tax on communication service is a better way of distributing wealth in such a way that would not affect the ordinary people. Ndume had explained that increasing VAT would have very deadly effect on the economy as it could affect the prices of goods and services and take them beyond the reach of ordinary people. The Communication Service Tax Bill will be pegged at 9% of the charge for the use of communication services. Ndume had informed reporters that he was going to meet with Osinbajo as head of the economic team to buy into the Communication Service Tax Bill. The bill reads in part: “There shall be imposed, charged payable and collected a monthly Communication Service Tax to be levied on charges payable by a user of an electronic communication service other than private electronic communication services.” The bill further stated that “the tax shall be levied on Electronic Communication Services supplied by Service Providers.” “For the purpose of this clause, the supply of any form of recharges shall be considered as a charge for usage of Electronic Communication Service.” Specifically, the bill provided that the “tax shall be levied on such Electronic Communication Services like voice calls, SMS, MMS, data usage both from Telecommunication Services Providers and Internet Service as well as pay-per-view TV stations.” If the bill is passed, “The tax shall be paid together with the Electronic Communication Service charge payable to the service provider by the consumer of the service. “The tax is due and payable on any supply of Electronic Communication Service within the time period specified under sub-clause (5) of whether or not the person making the supply is permitted or authorised to provide Electronic Communication Services.”   Source: The Sun

The Senate, yesterday, introduced an action to impose tax on Communication Services in the country. The planned new tax introduction Daily Sun learnt, is targeted at replacing the proposed 2.2 per cent increase in Value Added Tax (VAT) being mulled by the Executive.    The Bill for an Act to establish the Communication Service Tax which was formally introduced on the floor of the Senate yesterday is being sponsored by Mohammed Ali Ndume. Addressing newsmen after the first reading of the Bill was taken by the Senate, Ndume said the imposition of tax on communication service is a better way of distributing wealth in such a way that would not affect the ordinary people. The Bill reads in part: “There shall be” imposed, charged payable and collected a monthly Communication Service Tax to be levied on charges payable by a user of an Electronic Communication Service other than private Electronic  Communication Services.” The Bill further stated that “the tax shall be levied on Electronic Communication Services supplied by Service Providers.” “For the purpose of this clause, the supply of any form of recharges shall be considered as a charge for usage of Electronic Communication Service.” Specifically, the Bill provided that the “tax shall be levied on the such Electronic Communication Services like Voice Calls; SMS; MMS; Data usage both from Telecommunication Services Providers and Internet Service as well as Pay per View TV Stations” If the bill is passed, “The tax shall be paid together with the Electronic Communication Service charge payable to the service provider by the consumer of the service. “The tax is due and payable on any supply of Electronic Communication Service within the time period specified under sub-clause (5) of whether or not the person making the supply is permitted or authorized provide Electronic Communication Services.” On the agencies charged with the responsibility of collecting the tax, the Bill states: “The Federal Inland Revenue Service (FIRS) established under section 1 of the Federal Inland Revenue Service (Establishment) Act, 2007 shall be responsible for collection and remittance of tax, any interest and penalty paid under this Bill. “The FIRS shall pay the tax collected together with any interest and penalty into the Federation Account.” The bill further stated that all service providers shall file a tax return to account for the tax. “The tax return shall be in a form prescribed by the FIRS and shall state the amount of tax payable for the period and any related matters that may be required. “The return and the tax due to the accounting period to which the tax return relates shall be submitted and paid to the FIRS not later than the last working day of the month immediately after the month to which the tax return and payment relates.” The bill also stated that “the FIRS may extend the period within which the tax return may be submitted and payment made on application in writing by a service provider, where good cause is shown by the applicant. “The extension shall be communicated to the applicant in writing and shall state the circumstances under which the tax return shall be submitted for the particular period. “A service provider who without justification fails to submit to the FIRS the tax return by the date is liable to a pecuniary penalty of N50,000.00 and a further penalty of Nl0,000.00 for each day the return is not submitted.”   Source: The Sun

FIRS targets 45m taxpayers by December —Fowler

Federal Inland Revenue Service has said that about 45 million Nigerians will be captured as taxpayers before December 2019. Mr Babatunde Fowler, Chairman, Joint Tax Board said this on Thursday in Ilorin at the inauguration of the new Tax Identification Number registration system and consolidated National Taxpayers’ Database for North Central zone. “Over the last four years, the economic policies of the current administration have focused on establishing a stable foundation for socio-economic growth and development.    “With the astute leadership of Mr President, the milestones achieved bears ample testimony on the impact that has been made, not only in tax-revenue administration but in the environment of doing business in Nigeria,” he said. Fowler listed the accomplishments to include expansion of tax base from 10 million to 20 million taxpayers with the potential for an increase of up to 45 million before year end. Fowler, who is also FIRS Chairman, said Internally Generated Revenue collection at the sub-national level grew exponentially by 46.11 per cent from N800.02 billion in 2016 to N1.16 trillion in 2018. He also said FIRS tax collections grew by 53.9 per cent from N3.3 trillion in 2016 to N5.32 trillion being the highest collection ever in the history of FIRS. Fowler added that N2.85 trillion was collected as Non- Oil Revenue which accounted for 54 per cent of total revenue collection. The JTB chairman said the federal government paid a total of N135.8 billion as outstanding PAYE tax liabilities owed by Federal MDAs to states from 2002 to 2016 with a total of N31.08 billion paid to the states in the North Central. “We are confident that this gesture by the Federal Government will encourage State Governments to also reciprocate and promptly remit all Withholding Taxes and VAT due to the Federation Account. “A positive movement during the same period is Nigeria moving up 25 points in Tax Administration Section of World Bank ‘Ease of Doing Business’. “This positive progression is also reinforced by the recent listing of Nigeria as one of the ‘top 20 reformers in Doing Business for the year 2020 by the World Bank. “We expect that more positive country reports will be released by the time the full report by the World Bank is released on October 24, 2019,” Fowler said. He said the new TIN Registration System would improve on the efficiency and output of the entire tax administration process. “It is also meant to provide enhanced convenience to the taxpayers as well as the tax administrators while guaranteeing that each taxpayer’s details are readily available to them at their fingertips at all times and anywhere,” Fowler added.   Source: Punch

A bill for an Act to introduce tax on communication and cable television services scaled first reading at the Senate on Wednesday. The introduction of the tax, it was learnt, was to replace the 2.2 per cent increase in the Value Added Tax being planned by the Federal Government. The Bill for an Act to establish the Communication Service Tax was sponsored by a former Senate Leader, Ali Ndume. Briefing journalists shortly after the first reading of the bill was taken by the Senate, Ndume said the imposition of tax on communication service was a better way of distributing wealth in such a way that would not affect the ordinary people.   He said increasing VAT would have very devastating effects on the economy as it would raise prices of goods and services. The bill provides the charging of nine per cent on calls and data usage. The bill reads in part, “There shall be imposed, charged payable and collected a monthly Communication Service Tax to be levied on charges payable by a user of an electronic communication service other than private electronic communication services.  “The tax shall be levied on electronic communication services supplied by service providers. “For the purpose of this clause, the supply of any form of recharges shall be considered as a charge for usage of electronic communication service. “The tax shall be levied on such electronic communication services like voice calls, SMS, MMS, data usage – both from telecommunication services providers and internet service – as well as pay per view TV stations.  “The tax shall be paid together with the electronic communication service charge payable to the service provider by the consumer of the service.” The bill stipulates that the  Federal Inland Revenue Service would pay the tax collected together with any interest and penalty into the Federation Account. The Nigerian Stock Exchange (NSE) is in talks with authorities of the federal government to be considered for a five year extension of value added tax (VAT) over transactions performed on the floor of the Exchange.VAT text on wooden cubes above office calculator suggesting tax time or payment. Oscar Onyema, chief executive of the Exchange,  who disclosed this on the sideline of the 58th Annual General Meeting of the NSE held at the bourse’s office in Lagos on Monday, said the five year waiver initially granted the Exchange by the federal ministry of finance lapsed in July this year.   According to him, while in talks with authorities to get an extension of the VAT holiday on transactions performed on investment at the Exchange, the management of the bourse has reintroduced the tax. He said: “As you know, about five years ago, the Exchange received a waiver from the ministry of finance on VAT payment with regards to payments that are done on the floor of the exchange; and this was applicable not only to the Exchange but the CSCS and brokers that execute transactions at the exchange. “That five year waiver lapsed in July of this year. We started earlier on this year in January to engage with government and stakeholders to see if we can extend the waiver for another five year. Giving the softness in the economy and in the capital market, those conversations continue to go high.” While stating that the NSE is optimistic of a positive response from the government on the matter, Onyema stressed that the VAT waiver programme helps investors, and also puts the Nigerian Stock market in a very competitive footing. “This is because if you look at other markets that are competing for other floors with us across frontier and emerging markets, most of them have those waivers permanently in place. “Just recently, Ghana announced their own programme where there will be no VAT on transactions. So we are looking forward to receiving the same type of consideration from the appropriate authorities,” he said. Speaking on the demutualization of the exchange, Onyema noted that the management had achieved tremendously and remained fervently on course. “With regards to demutualization, we have made significant progress. As you know, in 2018, we got presidential assent to demutualization Act which set in place the appropriate legal framework for us to execute demutualization. We have gone ahead to complete and submit documentation with the Security and Exchange Commission (SEC) for their No Objection. “So, once we get their No Objection, we will come back and have meeting with membership to get their final vote. And if do get that final vote, we will then re-submit a formal application to the SEC to complete the mutualisation process and also to the Corporate Affairs Commission (CAC) to be registered as a demutualised Exchange,” he explained. He added that the management of the exchange had been doing all within its power to bring more issuers on board for the sake growing the valuation and wealth creation, reminding that the market is a multi-asset exchange that is ready to accommodate issuers from various sectors. While Onyema congratulated Nigeria at the occasion of its 59th Independence Anniversary, he charged the country work towards accelerating its growth rate. He said, “We must congratulate this nation for attaining this milestone of 59 years. Our aspiration for the nation is that it continues to be one nation that grows significantly and achieve its potentials which we all are always talking about. “We really need to achieve significant growth rate; and if possible, double digit growth rate. I think that is what will take us to our rightful position.” Meanwhile, analysis of the annual report of the Exchange for the 2018 financial year shows that the Exchange recorded N7.6 billion in revenue with a profit after tax of N2.7 billion in the year. Valuation of the market, as at December 30, 2018, stood at N21.9 trillion and the all share index (ASI) also stood at 45,092.83 bps. FIRS Is Right On Tax Liabilities

The recent action of the Federal Inland Revenue Service whereby corporate organisations and business houses which have refused to pay up their tax liabilities to government are sealed off and prosecuted is most salutary. There is nothing wrong in government’s determination to enforce the payment of taxes in the country. There is an urgent need to go back to the basics: the reason for the evolution of the State, the duties of the citizenry, their obligations and the social contract code must be re-examined. All things being equal, an efficient and effective tax administration is the first duty of the State, for taxation is synonymous with sovereignty. Efficient and effective taxation produced the money used in building the Pyramids of Egypt some five thousand years ago. It is in recognition of the autonomy of taxation that Jesus Christ, as recorded in the Holy Book, was quoted as saying that the people should give to Caesar that which belonged to Caesar and to God, that which was His.  Even in Nigeria, in the First Republic, the late sage, Chief Obafemi Awolowo used efficient and effective taxation to build the Western House in Lagos, the Cocoa House in Ibadan and numerous companies and housing estates in the defunct Western Region. The government of the Eastern Region under Dr. Michael Okpara which was driven by efficient and effective taxation system was declared the fastest growing economy in the Commonwealth of Nations. The modernization of traditional administration in the defunct Northern Region under Sir Ahmadu Bello, employed efficient and effective taxation system for the rapid transformation of the North through agriculture. It is therefore unfortunate that with the discovery of oil in commercial quantity and the abolition of regionalism in the wake of military intervention in our body politic, Nigeria was turned into an indolent State wholly dependent on proceeds derived from crude oil. Be that as it may, there is some good logic in government’s decision to confront the issue of long overdue tax liabilities albeit belatedly. It is apposite that there is so much tax money out there running into trillions of Naira not remitted to the FIRS by many corporate organizations and business houses. It therefore appears that government is not even aware of what the outstanding debt amounts to. The reality is that until the issue of fiscal federalism is resolved the poor state of tax management will continue to be a vicious circle. But, ideally, a democracy is supposed to be sustained by millions of tax payers who in turn demand for free and fair elections and dividends of democracy as reciprocal. Yet, what makes the current drive curious is government’s intention to use the Economic and Financial Crimes Commission (EFCC) for tax recovery even when the Ministry of Finance has relevant powers to enforce tax compliance. Consequently, it is observed that taxes and levies on companies appear to be the rage. The ravaging effects of this phenomenon on the economy and commercial life of the country are painfully obvious for all to see. Productivity and future investments are being undermined and cost-induced inflation by the current, in some cases, reckless, application of taxation policies. Manufacturers are complaining that rather than creating an enabling environment for economic growth, government is promoting a crushing burden of over-taxation as well as the misapplication of the tariff system. The direct result of the atmosphere is not only the paucity of fresh direct foreign investment but also the spate of divestment which has continued unabated. In addition, the unit cost of production has become not only uneconomical for local consumption which has been ravaged by low purchasing power; it also makes the often touted diversification of the nation’s export structure an unfeasible proposition. It is lamentable that due largely to the preponderance of easy oil money, some of the essential tenets of the taxation system are being forgotten. The principle of taxation entails not just the gathering of revenues for today’s purposes; it also includes the fundamental riders: that an enabling environment be provided to attract investments which would lead to the creation of a bigger and qualitatively better revenue generation base tomorrow. While the battle for direct foreign investment is being won in other lands, by creating a conducive atmosphere through measures such as tariff reduction, tax holidays, grants and so forth, here, we have chosen to follow a different route as the myriads of divestment amply testifies. Various forms of taxes and purgative levies are being duplicated among the federal, state and local governments. The country has now taken on the garb of a rental state, a creature which lives on the collection of rents (taxes) and not acting as the facilitator of production. Given the illegality of taxes being levied across the country as a result of the dwindling oil revenue, it behooves the government to come out clearly with a list of approved taxes which can be levied at the various tiers of government. Basically, the authorities must ensure that the country is returned to a formal structure of record keeping whereby people’s sources of income are known and are taxed adequately under a true federal structure. Again, our regulatory agencies and agents must not only do their jobs, they must be seen to be doing their jobs. A situation whereby a company registered in the British Virgin Island, for instance, would have a proliferation of subsidiaries in Nigeria which rake in so much money from the country and export their revenues abroad without paying tax in Nigeria is economic sabotage.
